BuyMekato Auction & Marketplace Rules

Version: 9 September 2026 — supplier-request update. These rules form part of the agreement between each marketplace user and Creations Industrial Design CC, operator of BuyMekato. They supplement the general Terms and Privacy & Marketplace Safety Notice.

1. BuyMekato’s role

BuyMekato provides listing, bidding, messaging, moderation and notification tools. Unless BuyMekato expressly states otherwise for a particular transaction, it is not the seller, buyer, auctioneer of record, carrier, insurer, authenticator, repairer, escrow provider, or agent of either user. Buyer and seller remain responsible for the item transaction, inspection, payment, delivery, taxes, permits and compliance with applicable law.

2. Seller eligibility and responsibilities

  • BuyMekato is strictly for people aged 18 or older. Minors may not register, buy, bid, sell, submit verification documents, or use another person’s account.
  • You must provide an accurate date of birth, be legally able to contract, control the account, and own the item or have documented authority to sell it.
  • The discounted Student Seller plan is only for adult current students approved by BuyMekato. Student proof must be genuine, current and belong to the account holder. False documents or misrepresentation may result in rejection or suspension.
  • Your photographs and description must accurately disclose identity, condition, authenticity, provenance where claimed, material defects, included parts, collection or delivery method, and all buyer costs.
  • You must not list stolen, counterfeit, recalled, unsafe, illegal, regulated without authority, infringing, or otherwise prohibited goods.
  • You must not bid on your own item, arrange artificial bids, use another account to inflate the price, manipulate timing, or misrepresent payment or identity.
  • After a valid bid, core price and timing settings are locked. If the reserve is met, the seller must act in good faith to complete the sale with the winner.

3. Listing fees, free allowance and approval

  • The first two submitted auction listings per seller account are free, unless the current pricing page or an authorised promotion states otherwise. Deleting an auction does not restore a used free credit.
  • After the free allowance, a listing fee is calculated from the selected auction duration using the prices displayed before submission. The server-calculated amount controls if a browser estimate differs.
  • A paid auction remains private until BuyMekato verifies the listing-fee payment and an administrator separately approves the item. Payment does not guarantee approval.
  • Listing fees cover processing, moderation and publication. A fee may be refused, credited or refunded where required by law or expressly agreed by BuyMekato. Fees are otherwise not refundable after review or publication merely because an item receives no bids or does not sell.
  • BuyMekato may require identity, ownership, authenticity or payment evidence before approval, and may reject, pause or remove a listing that presents a legal, safety, fraud, quality or policy concern.

4. Bidding

  • Only bid when you intend and are able to pay. A winning bid is a serious commitment to buy, subject to the item materially matching its listing and applicable law.
  • The highest valid bid at closing wins if any reserve price is met. BuyMekato may invalidate bids linked to error, abuse, collusion, unauthorised access or suspected fraud.
  • Each bid must meet the displayed minimum increment. A valid bid in the final two minutes extends closing to two minutes after that bid.
  • Automated disruption, scraping that harms the service, bid manipulation and interference with other users are prohibited.

5. Item payment, inspection and handover

Listing-fee payment to BuyMekato is separate from the winner’s payment to the seller. Until an approved marketplace checkout or escrow service is expressly shown, buyer and seller arrange item payment and handover directly. Inspect before handover where practical; use traceable payment; confirm cleared funds; agree delivery costs in writing; and never share passwords, card PINs or one-time PINs. Never send money merely to “release” a payment.

6. Supplier requests and quotations

  • Buyers must post genuine, lawful requirements with an accurate description, quantity or scope, general delivery area and realistic deadline. Private contact details and street addresses must not be placed in a public request.
  • Suppliers may quote only when they reasonably believe they can provide the stated product or service. A quotation must accurately state the total price, delivery estimate, validity period, material inclusions, exclusions, VAT position where relevant, and payment terms.
  • False requests, fake quotations, collusion, unsolicited advertising, attempts to move users into suspicious payment schemes, and misuse of personal or business information are prohibited.
  • Administrator approval means only that a request may appear on the platform. It is not certification of the buyer, supplier, requirement, quotation, legality, quality, capacity, solvency or future performance.
  • Accepting a quotation records the buyer’s selection on BuyMekato. Unless an authorised BuyMekato checkout, escrow or procurement service expressly says otherwise, the final contract, due diligence, invoice, payment, delivery, tax and dispute remain directly between buyer and supplier.
  • BuyMekato may moderate, reject, close or preserve a request or quotation where reasonably necessary for safety, law, fraud prevention, system integrity or enforcement of these rules.

7. Reports, disputes and enforcement

Report suspected fraud, inaccurate listings, prohibited goods, non-payment or non-delivery promptly with relevant records. BuyMekato may investigate, request information, warn users, limit features, remove content or bids, suspend accounts, preserve records, cooperate with lawful authorities, and reverse a platform status where reasonably necessary. BuyMekato does not guarantee recovery of an item or funds and is not obliged to decide private ownership or authenticity disputes.

8. Warranties and limitation of liability

To the maximum extent permitted by applicable law, the platform is provided on an “as available” basis. BuyMekato does not guarantee that a user is who they claim to be, that an item is authentic, safe or lawful, that bids will lead to a completed sale, or that the service will be uninterrupted. Users must perform their own checks.

To the maximum extent permitted by applicable law, Creations Industrial Design CC is not liable for indirect, incidental, special or consequential loss arising from a user’s item, conduct, payment, delivery, misrepresentation, unlawful act, device or third-party service. Nothing in these rules excludes or limits liability that cannot lawfully be excluded, or excuses BuyMekato’s own fraud, wilful misconduct, gross negligence, or statutory duties.

9. User responsibility and indemnity

You are responsible for your account and content. To the extent permitted by law, you agree to reimburse Creations Industrial Design CC for reasonable loss and third-party claims directly caused by your unlawful listing, infringement, fraud, bid manipulation, material breach of these rules, or unauthorised use of another person’s rights, except to the extent caused by BuyMekato’s own wrongful conduct.

10. Privacy, records and governing law

BuyMekato processes marketplace and security records as described in its policies. These rules are governed by the laws of Namibia. Mandatory rights and remedies under applicable law remain available. If one provision is unenforceable, the remaining provisions continue to apply.
